These Terms of Service (“Terms”) apply to the website operated by Aligned Beginnings Pty Ltd and, together with any individual service agreement, to the disability and community support services we provide. By accessing this website, requesting a quote, or engaging our services, you agree to these Terms. Please read them carefully.

1. Who we are

Aligned Beginnings Pty Ltd (ABN 93 701 353 620) is a provider of disability and community support services based in Perth, Western Australia. References to “we”, “us” and “our” in these Terms mean Aligned Beginnings Pty Ltd. References to “you” mean the person using this website, or the participant, nominee, guardian, plan manager or other representative engaging our services.

2. Information on this website is general

The content on this website is provided for general information only. It does not constitute professional advice about your individual circumstances, support needs or NDIS plan. While we take reasonable care to keep information accurate and current, we make no guarantees that the website will always be complete, up to date or free from errors. You should contact us directly before relying on any information on this website to make decisions about your supports.

3. Our services

We provide disability and community support services, which may include assistance with daily personal activities, community participation, respite support, in-home supports and transport to appointments and community activities. The specific services we provide to you, along with the agreed hours, rates, locations and any conditions, will be set out in a written service agreement between you and us. In the event of any conflict between these Terms and your service agreement, your service agreement will prevail to the extent of the inconsistency.

4. Quotes and service agreements

Any quote provided through this website or otherwise is an estimate only and is not a binding offer. A binding arrangement only arises once both parties have signed a service agreement, or once we confirm a booking in writing. Quotes are based on the information you provide to us; if your needs, schedule or funding arrangements change, we may need to revise the quote before services commence.

5. Fees, invoicing and payment

Fees for our services will be set out in your service agreement and in any written quote. Unless otherwise agreed in writing:

• If you are an NDIS participant, we will claim payment in accordance with your plan management arrangement (self-managed, plan-managed or agency-managed) and the NDIS pricing arrangements and price limits that apply at the time the support is delivered.
• If you are a private client, invoices are payable within the period stated on the invoice.
• You are responsible for informing us promptly if your funding, plan manager or eligibility status changes.

If you believe an invoice is incorrect, please contact us by email so we can review it. We will not pursue a disputed amount while it is being reasonably investigated.

6. Cancellations and changes

We understand that plans change. Our cancellation expectations (including any short-notice cancellation charges) will be set out in your service agreement and will follow the NDIS cancellation rules where those apply. If you need to reschedule or cancel a shift, please notify us by email as early as possible so we can adjust rosters and support other clients. We will also give you as much notice as we reasonably can if we need to reschedule a support worker or service.

7. Your responsibilities

To help us deliver safe, quality supports, you agree to:

• Provide accurate and up-to-date information about your support needs, health, safety and funding.
• Treat our support workers and staff with respect, courtesy and fairness.
• Give us reasonable notice of any changes to your circumstances, medications, routines or risk factors that may affect service delivery.
• Maintain a safe working environment for our staff in your home and comply with reasonable safety directions.
• Tell us promptly if you are unhappy with any aspect of your supports.

We may review, vary or end a service agreement in accordance with its terms if these responsibilities are not met, or if we cannot deliver supports safely.

8. Privacy

We handle personal and sensitive information in accordance with the Australian Privacy Principles and our privacy policy, which is available at privacy.html. Our privacy policy forms part of these Terms.

9. Intellectual property

All content on this website, including text, layout, graphics and the Aligned Beginnings name and branding, is owned by or licensed to Aligned Beginnings Pty Ltd and is protected by Australian copyright and trade marks law. You may view, download and print pages for your own personal, non-commercial use. You may not reproduce, republish or use our content for commercial purposes without our prior written consent.

10. Links to other websites

This website may contain links to third-party websites, including government and NDIS resources. These links are provided for convenience only. We do not control, endorse or accept responsibility for the content, accuracy or privacy practices of any third-party website.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies that you have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other rights you have under Australian law that cannot lawfully be excluded.

Our services also come with guarantees that cannot be excluded under the Australian Consumer Law. For services, you are entitled to a remedy if the services are not provided with due care and skill, are not reasonably fit for purpose, or are not provided within a reasonable time.

To the fullest extent permitted by law, and subject to the guarantees described above, we limit our liability for any claim arising from our services or this website. Where the Australian Consumer Law applies and permits limitation of our liability, we limit our liability, at our option, to the resupply of the relevant services or the cost of resupplying them. We are not liable for indirect or consequential loss, except where such liability cannot lawfully be excluded.

12. Complaints, feedback and disputes

We welcome feedback and treat complaints seriously. If you are unhappy with any aspect of our services, please contact us by email at ceo@alignedbeginnings.site with details of your concern. We will acknowledge your complaint and work with you towards a fair resolution.

If you are an NDIS participant and we cannot resolve a concern to your satisfaction, you may contact the NDIS Quality and Safeguards Commission. If you have a general consumer concern, you may also contact the relevant consumer protection agency in Western Australia.

13. Governing law

These Terms, and any service agreement with us, are governed by the laws of Western Australia and the Commonwealth of Australia. The parties submit to the jurisdiction of the courts of Western Australia.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, the law or NDIS requirements. The current version will always be published on this page with the date of last update shown above. Continued use of this website after changes are published constitutes acceptance of the updated Terms. Material changes affecting an existing service agreement will be communicated to you directly and discussed before they take effect.
